In construction contractual relationships, penalties for breach and damages are two key legal mechanisms for risk allocation, enhancing contract compliance, and addressing the consequences of contractual breaches. However, these issues also frequently give rise to disputes in practice, particularly in the context of construction contracts, which are often complex in structure, high in value, long in duration, and governed by multiple sources of law as well as international standard forms of contract.
In this context, to facilitate discussions on the legal framework, practical approaches to application, and comparative experiences drawn from international construction law and standard contracts, the Vietnam Society of Construction Law (SCLVN) is organizing an online seminar titled “Liquidated Damages in Construction Disputes: Legal and Practical Perspectives”. Through expert presentations and panel discussions, the webinar aims to clarify existing ambiguities in legal interpretation and application, thereby contributing to more effective drafting, performance, and dispute resolution of construction contracts in Vietnam.
